HEARINGS IN MARYLAND
“Satellite Parking” is a one act play written by Paul Handy, Administrative Law
Judge for the District of Columbia Office of Administrative Hearings. The play
is fictional, but it is based on two true stories arising out of commitment
hearings in Maryland. The play will be directed by Judge Handy and performed by
a cast in a staged reading.

INTRODUCTION TO COLLABORATIVE LAW AND ITS APPLICATION TO CIVIL DISPUTES
Collaborative Law has created a resurgence of ADR in many areas of law. With
the recent amendment to Rule 2.1 of the Rules of Professional Responsibility
every attorney should be providing their clients with information on all ADR
methods appropriate for their disputes. This session will provide you with a
basic introduction to the guiding principles of Collaborative Law. The speakers
are two attorneys from Massachusetts who have successfully applied Collaborative
Law principles in business disputes, including the break up and restructure of
an "S" Corporation. Learn how you can use the collaborative process to
efficiently and successfully resolve issues in a wide range of business disputes
and other areas, including, contractor/ subcontractor disputes, breakup and
restructuring of closely held and family
businesses, probate disputes, non-profit entity internal disputes and
employer/employee disputes. A role play demonstration will give you insight into
how a collaborative law case works. Learn about opportunities to become a
certified collaborative practitioner and about the International, State and
local organizations that support this innovative method of ADR.

MARYLAND DISCOVERY PROBLEMS AND SOLUTIONS - HOW TO SOLVE THE MOST FREQUENTLY
ENCOUNTERED PROBLEMS IN CIVIL PRE-TRIAL PRACTICE, INCLUDING ISSUES RE: DISCOVERY
OF ELECTRONICALLY STORED INFORMATION (ESI)
Cases can be won or lost during discovery. With the decline in the number of
civil cases reaching trial, discovery has emerged as the central battleground
and the costliest part of litigation. Courts are forever conducting conferences
and hearings to resolve discovery disputes. Evaluation of cases for settlement
is based in large part on discovery, driving the process - and the costs to the
client - even more. Recent amendments to the Maryland Rules of Civil Procedure
governing the discovery and use of electronically stored information (ESI) have
added another layer of complexity to pre-trial practice. U.S. Magistrate Judge
Paul Grimm, Charles Fax and Paul Sandler, co-authors of the new MICPEL book
“Maryland Discovery Problems and Solutions,” will discuss the problems that
civil litigators encounter most frequently in pre-trial discovery, and present
suggestions and strategies for solving these problems.
The program begins with an overview of the scope and types of discovery
contained in the Maryland Rules of Procedure, with special emphasis on ESI. The
faculty will then present a fast paced, informative and entertaining vignette
highlighting problems and illustrating how NOT to conduct your next deposition,
conference or hearing. Finally, the faculty will answer your questions and offer
their perspective and advice on how to solve your current problems or disputes
concerning interrogatories; document requests; requests for admission; motions
for mental and physical examinations; depositions; experts; sanctions, and

RECORDS ESSENTIALS FOR BUSINESS ATTORNEYS
This program is designed to provide practitioners with an overview of current
standards for the management and protection of metadata and other emerging
electronic records (ESI) issues in business transactions and practices. Both law
firms and their clients have exponentially increased the amount of electronic
records in transactions while numerous legal, technical and business issues have
surfaced, such as how to prevent inadvertent disclosure of client information
buried within electronic documents, the cost of
maintaining ESI, security threats, privacy concerns, in addition to ESI related
regulations and the associated liability. Attorneys and organizations of all
sizes now face a fundamental business challenge: how will they responsibly
transmit, store, manage, and protect ESI while negotiating business transactions
and operating their businesses practices. This session will provide an overview
of the evolving issues involving metadata and electronic records from a business

THE WOLF AND THE SCARECROW AT THE DOOR: REVERSING THE HIGHJACKING OF THE
AMERICAN DREAM
This program will focus on the sub prime mortgage crisis which is plaguing
America. The panel, consisting of experienced bankruptcy and foreclosure
practitioners, will discuss various aspects and ramifications of the crises
generally within the context of bankruptcy relief but also with an eye toward
out of bankruptcy workouts and remedies. Topics to be discussed and examined
include foreclosure rescue scams, dealing with sub prime property loans inside
and outside of bankruptcy, post default costs and charges added to the loan
amount for foreclosure by the lender or servicing agent, proposed bankruptcy,

Judge Murphy’s recent opinion for the Court of Special Appeals in Schoukroun v.
Karsenty, 177 Md. App. 615 (2007) expands the spouse’s elective share to

solidifying their immortality as they meet head-on in what has come to be
known as the "Scopes Monkey Trial". Judge John T. Raulston is presiding. Stage
Right: Same trial, same scholars are preparing their presentations. However,
this time the court has ordered the parties to participate in mediation.
