MINUTES OF SECTION COUNCIL MEETING OF NOVEMBER 27, 2000
A meeting of the Health Law Section Council was convened at approximately
5:40 p.m. on November 27, 2000, at Bar Association Headquarters in the Conference
Room. Present at the meeting were Carolyn Jacobs, Maria Filardi, Jim Jacobs,
Linda Jones, Janet Brown and David Tralins. Mr. Tralins announced that due
to the death of Mike Schaefer’s partner on November 1, Mike could not
attend due to his workload.
1. Mr. Tralins asked the Council if there were any suggestions for budget
submissions for the fiscal year ending June, 2001. Mr. Tralins announced to
the Council that Fred Ryland had proposed a joint presentation with the University
of Maryland Law School during the next academic year on an item or items of
health care involving an ethical component. This could require some additional
funding. A suggestion was made to discuss the budget with Fred Ryland before
submission to the State Bar.
2. None of the Council members present had any suggested legislative topics
for the year. The issue of a requirement that there be representation at the
investigatory stages before all State health licensing Boards was discussed.
However, there was no specific proposal for legislation in this regard. Mr.
Tralins presented and discussed a survey developed in the form of a matrix
addressed to Del. Al Redmer and others regarding the comparative roles and
responsibilities of the Health Occupations Boards and which presented that
material in a consolidated format.
3. There will be a meeting with Mary D’Anna on Thursday, December 14th at
8:00 a.m. at Windows restaurant in Baltimore, during which a discussion will
be held with her concerning the development of a MICPEL program which will
focus on general practitioners representing providers. The program will be
co-sponsored with MGMA and MedChi and will be tentatively held in late Spring
of 2001. The focus will be on physicians and generalists. The last time such
a presentation was held, about 90 people attended in Columbia, Maryland, according
to Jim. Anyone interested in attending the meeting should call Nancy or Jim.
4. Carolyn Jacobs provided an update on her view of the Ocean City Program
this summer. She presented to the Council a proposal to focus on
"E-Health" issues. This subject would cover such areas as HIPAA,
tele-medicine, and internet medicine. It would deal with issues such as business
relationships, advertising, licensing, and be more cutting edge in its nature.
There was concern among the Council members present that this topic may be
too focused and not broad enough for attendees at the Ocean City meeting. Janet
Brown remarked that there had been a good deal of discussion among the Joint
Federation of Medical Boards and the issues surrounding licensing and where
you were practicing. Upon further discussion, it was decided that Carolyn would
report back to David Tralins upon her return from a conference in San Francisco
on the topic of E-Health issues in order to crystalize thoughts in connection
with that topic. Ultimately, the consensus was that the Program should be divided
into two portions on E-Health issues and Compliance, and the Section will proceed
on that basis.
5. The matrix which was sent to Mr. Redmer was discussed at some length with
Janet Brown. Janet will continue her coordination efforts with Marc Cohen in
connection with the January program. The topic of representation during the
investigative stage of a Board complaint was discussed at length.
6. Two articles have been committed to the Bar Bulletin. One of them will
be authored by Chris Williams at Gordon, Feinblatt on health law privacy. The
other will be authored by Mr. Tralins on physician compliance. Volunteers for
the third article were sought from those present. Linda Jones indicated that
she would get back to Mr. Tralins regarding the publication of an article on
her part or, in the alternative, Jim Jacobs has offered to participate in writing
an article if a third source cannot be found.
