Cannabis and the Workplace

The panel will discuss employment and labor law implications with recreational and medical cannabis. The panel will focus on Maryland and Federal law while also highlighting lessons from other jurisdictions. The varying ways in which cannabis is classified affect employer obligations and employee rights, including under the ADA, the Maryland Fair Employment Practices Act, the National Labor Relations Act, and Title VII. The panel will discuss the nuances of the interplay between these laws and recreational and medical cannabis, obligations to bargain with the union(s) representing employees, best practices for complying with applicable laws, and Maryland’s drug testing rules.
