Getting to Guardianship: Alternatives, the Process, and the

This seminar will address: (1) alternatives to guardianship, such as the new supported decision-making statute, specific transaction, powers of attorney, and other options; (2) the process to obtain guardianship, including if the petitioner cannot obtain the 2 medical certificates and the players in most guardianship cases, including the role of court-appointed counsel and perhaps APS; (3) the impact of guardianship on the alleged disabled person's rights, for instance voting, driving, gun ownership, and marriage; and (4) do's and don'ts of serving as guardian of person and/or property, such as a guardian's authority (or lack thereof) to take certain actions, such as change beneficiaries and involuntarily commit a ward for psychiatric treatment, how to title accounts and invest assets, how to handle the sale of real property, intersection of guardianship and other cases, such as divorce or personal injury, and how to handle interstate guardianship issues.

One hour credit will be offered for the surrounding MCLE states of Virginia, Delaware and Pennsylvania.
