Lost in Translation: Using Translated Statements Accurately at Trial

Testimony and materials that start out in a language other than English can inject confusion into any case. During this session, focused primarily on the criminal defense and immigration contexts, we will first consider discovery review, including which party is responsible for providing an English translation and difficulties with disputed interpretations. We will proceed with an overview of rules and case law on the use of translated statements in court, including exclusionary challenges grounded in hearsay, confrontation, authentication, and reliability. Finally, we will focus on trial practice tips, including impeaching a witness in a language other than English, working effectively with court interpreters, and ensuring that translated evidence that you put forward is clear for your factfinder.
