In this program, leading journalist-turned-litigator Chelsea Crawford will broadly discuss ways to challenge and/or limit mental examinations pursuant to Rule 35 of the Federal Rules of Civil Procedure. Mental examinations are common in cases where a plaintiff is claiming mental health or emotional distress damages. This program will explore when such damages are truly “in controversy” and what constitutes “good cause” for mental examinations in the District of Maryland and beyond. This program will also examine ways to set parameters or limit the scope of any mental examination in the event that the Court orders an examination and how to remain client-centered throughout the Rule 35 process.
